  • Syngene International Limited and its subsidiaries (“Syngene”/ “we”/ “us”/ “our”) appreciate you visiting our website and your interest in our services. We are committed to protecting your personal data and respect your privacy.

This privacy notice describes the categories of personal data collected, purposes of collection, and the manner in which it is processed, used and disclosed, in accordance with applicable data privacy laws, the rights available to you to limit our use of your personal data. We encourage you to read this privacy notice in full and contact us with any questions or concerns you may have. The applicability of the Privacy Notice is global, however certain additional information may be relevant to you depending on the region where you reside. Such additional terms, based on these particular countries or regions, are called out in region-specific notices below.
  • (b). This privacy notice is also applicable to any personal data collected by us through email or through telephone. We have specific notices and consent forms for participants of clinical trials and research studies conducted by us, candidates who have applied using career portals and employees. The terms of such specific notices and consent will prevail over this privacy notice in case of any inconsistencies. Any personal data that you share about other individuals is shared by you, only after obtaining consent from the person to whom the personal data belongs, and you shall be responsible for complying with applicable privacy and data protection laws.

Ⅲ. COLLECTION AND PROCESSING OF PERSONAL DATA

‘Personal data’ means any information that can be used to identify a person, including but not limited to name, address, email address, telephone number, medical and health information.

  • (a) We will process any personal data that we collect in accordance with applicable laws and regulations. We may process your personal data when you:
    • (i) visit our websites or our physical locations;
    • (ii) use our services;
    • (iii) use our job application portal;
    • (iv) sign up to receive information or newsletters from us;
    • (v) submit inquiries with us;
    • (vi) register to participate in our clinical trials or research studies or are an existing or prospective clinical investigator or member of investigation study team;
    • (vii) attend professional or educational events we sponsor, attend or hold;
    • (viii) exchange business related communications with you including when you contact us, provide feedback, or otherwise;
    • (ix) exchange marketing information such as your preferences for receiving our marketing communications and details about your engagement with them.

We get your information directly through you, your employer, our customers, your devices, our systems and/or through our business partners or third parties. Our legal bases for processing personal data are (on a case-to-case basis) legitimate use/interests, to perform our contract with you and based on your consent, where we take your consent and other cases required by applicable laws. We do not collect or process personal data of minors without the permission of such minor’s parents or guardians.

  • (b) The nature of personal data we process if you are a visitor of our website or submit inquiries or sign up to receive information or newsletters or attend or participate professional or educational events we sponsor, hold or participate are:
    • o name

    • o phone number
    • o company name
    • o username and password
    • o audio-visual information such as photographs or images captures, video recordings (if enabled) when attending any of our events or webinars etc
    • o technical information such as IP addresses, browser information, demographic information, device information, data collected from cookies detailed under our cookie policy.

We process the said personal data to provide you with our services, to communicate with you and your organisation, to send you updates, marketing and other information, to detect security incidents, to authenticate you, to protect against malicious or illegal activity, to perform data analytics to improve our Services and offerings and enhanced website performance, for system administration purposes, to respond to regulatory or government bodies as required by law, to invite you for events, seminars and such functions organized by us and related purposes such as running marketing campaigns, to generate and maintain leads as part of our customer relationship management database. When you contact us, we may keep a record of such correspondence. We may collect personal data by asking you to complete surveys that we would use for research purposes, although you have a right not to respond to them. We may also process your personal data set above and additionally certain commercial and financial information, when you act as our vendor, supplier or service provider for business purposes and to process payments and invoices.   • (c) The nature of personal data processed from third party sources: When you engage with us through social media sites, you may allow us to have access to certain information from your social media profiles based on your preference settings on such platforms. We may also receive your personal data from third parties who have taken your consent to be contacted by persons or entities like us for marketing and other purposes including for employment/ apprenticeship/ internship purposes, business purposes and trial/ study participation. We may obtain personal data from third parties, such as marketing partners, publicly available sources and data providers.

  • (e) The nature of personal data processed when you register with us as volunteers interested to participate in clinical trials or research studies conducted by us include:
    • o name
    • o email address
    • o phone number
    • o state/ pincode
    • o confirmation that the individual is above 18 years of age.

The above information is used by us to contact you to provide you with our clinical trials/ research study related information and for your consequent participation. If you are a participant in our clinical trials or research studies, further information including medical and health related information will be collected from you. However, specific consents and notices with respect to the same will be provided to you prior to your participation in case of such trials/ studies. Please note that all your data including your identity in connection with such clinical trials and studies shall be kept confidential and protected as per the applicable legal requirements.

For certain the personal data processing activities we undertake, we may use AI, machine learning and related technologies to improve customer experience and data analytic capabilities. Whenever we do so, we adhere to responsible AI practices and comply with applicable regulations.

Ⅳ. LEGAL BASIS OF THE PROCESSING

The applicable privacy and data protection laws provide for certain justifiable grounds for collection and processing of personal data, commonly referred to as legal basis of processing. We primarily rely on the following legal bases, subject to applicable laws:

Ⅴ. TRANSFER OF PERSONAL DATA ACROSS NATIONAL BORDERS

The personal data collected from you and processed may be transferred and maintained outside of your state or country, however, we have put in place lawful transfer mechanisms and adequate safeguards to protect your personal data in accordance with applicable laws. By using our services and providing us with your personal data, you acknowledge and consent to the transfer, processing, and storage of your personal data in jurisdictions outside your country of residence, subject to the safeguards set out here.

Where we may transfer the data outside your country or region of residence, we shall take reasonable and appropriate steps in line with applicable laws while executing such transfer. We may also be required to share such information with regulators/ government authorities as required under applicable laws.

Syngene does not sell personal data to third parties. We may share certain data with third-party partners who work with us to provide the services or help us improve or administer our services, clinical investigators and/or members of the investigator teams. We execute agreements including confidentiality requirements with all such third-party partners and they are also required to comply with applicable laws and regulations to perform their services for us.

Our Services may contain links to third party websites, applications or services, which are not owned or operated by Syngene. Please note that Syngene is not responsible for the privacy notices/policies, practices, or the contents of such third-party websites. We use cookies and similar technologies to facilitate proper functioning of our website and to help collect certain data. Personal data will not be retained for a period more than necessary to fulfill the purposes outlined in this privacy notice unless a longer retention period is required by law or permitted by applicable law. Personal data may be retained for the following purposes: (i) to fulfil contractual or operational obligations; (ii) to comply with legal and regulatory requirements; (iii) to resolve disputes and enforce legal rights. Upon expiry of the applicable retention period or fulfilment of the purposes for which personal data was collected we will securely delete or anonymize the personal data, unless further retention is required by law.

XIII. CHILDREN’S PRIVACY

Sygene’s websites, its associated services and hosted contents, are not intended for use by children. As such we do not knowingly solicit or collect personally identifiable information online from children without prior verifiable parental consent. If Syngene learns that a child has submitted personally identifiable information online without parental consent, it will take all reasonable measures to delete such information from its databases and to not use such information for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law).
